1. Acceptance of Terms

By downloading, accessing, or using the GymSym mobile application ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use the Service.

2. Description of Service

GymSym is an AI-powered health and fitness assistant that provides:

• Form Analysis: Computer vision analysis of exercise videos to suggest technique improvements.
• Nutrition Tracking: AI estimation of calories and macronutrients from food images.
• VitaLens: Wellness analysis based on visual inspection of the tongue and face (Glossoscopy).

New users are granted 20 free credits (video scans) upon account creation. Continued use of the service requires an active subscription or purchase of credit packs.

3. AI Accuracy & Technology Limitations

You acknowledge that GymSym uses Artificial Intelligence (AI), Computer Vision, and Machine Learning technologies. While we strive for high accuracy:

• The Service may occasionally generate incorrect information regarding form, calorie counts, or health biomarkers ("Hallucinations").
• Results can be heavily influenced by lighting conditions, camera angles, and device quality.
• You agree to use your own judgment and not rely solely on the AI for safety-critical decisions.

4. Medical Disclaimer (Critical)

NO MEDICAL ADVICE: The GymSym Service, including the "VitaLens" tongue analysis feature, is for informational and wellness purposes only. It is NOT a medical device and does NOT provide medical diagnosis, treatment, or advice.

The "health scores" or "biomarkers" presented are estimates based on visual data and general wellness principles. They should not be interpreted as clinical results. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

5. Subscriptions and Payments

GymSym offers auto-renewing subscription plans to access premium features:

5.1 Subscription Plans

• Weekly Plan: $6.99 billed every week.
• Monthly Plan: $9.99 billed every month.
• Quarterly Plan: $14.99 billed every 3 months.

5.2 Billing & Cancellation

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

5.3 Refunds

Subscription payments are generally non-refundable except as required by applicable law or the policies of the Apple App Store or Google Play Store.

6. User Content & Privacy

You retain ownership of the videos you upload ("User Content"). By uploading content, you grant GymSym a non-exclusive license to process this content solely for the purpose of providing the analysis. We prioritize your privacy and process video data securely. Please refer to our Privacy Policy for details on how we anonymize and protect your data.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GYMSYM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY PHYSICAL INJURY INCURRED WHILE PERFORMING EXERCISES SUGGESTED BY THE AI.

YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH EXERCISE AND PHYSICAL ACTIVITY.

8. Changes to the Terms

We reserve the right to modify these terms at any time. If we make material changes, we will notify you through the App or via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
